С памятником культуры поручили разбираться участковому
В «Выборгских ведомостях» (№32 от 19.08.2016) был опубликован материал «Исторический Выборг в ситуации правового безвластия». В нем шла речь о том, что на охраняемом объекте культурного наследия «Комплекс «Дворец наместника»» ведутся явно незаконные работы. Вслед за публикацией было подано также заявление в полицию с просьбой остановить беззаконие, наносящее непоправимый ущерб памятнику культуры.
В ответ полицейское руководство поручило … участковому уполномоченному перенаправить это заявление в департамент охраны памятников.
После публикации в газете упомянутого сюжета, в редакцию поступило письмо из УМВД России по Выборгскому району Ленинградской области, полностью подтверждающее изложенные в материале факты:
«В связи с опубликованной в вашей газете статьи «Исторический Выборг в ситуации правового безвластия» просим вас опубликовать наш комментарий: «В ГУ МВД России по г.Санкт-Петербургу и Ленинградской области заявили, что указанное обращение не было проигнорировано полицией. В соответствии с действующим законодательством обращение рассмотрено и направлено по компетенции в Департамент государственной охраны, сохранения и использования объектов культурного наследия Комитета по Культуре Ленинградской области»».
Но слова «в соответствии с действующим законодательством» заставляют в интересах общества этот комментарий прокомментировать.
Итак, полиция почему-то безоговорочно поверила заявителю: да, действительно, строительство ведется именно на объекте, охраняемом законом, надзор за которым надлежит вести департаменту охраны памятников. Но никаких документов, свидетельствующих об этом, в деле нет. Нет акта осмотра места преступления, расположенного в полусотне метров от здания УМВД, не сделан запрос о статусе объекта, его собственнике и пользователе, не установлены лица, орудующие в доме наместника.
То есть никаких действий, связанных с проверкой фактов и обстоятельств, изложенных более полутора месяцев назад в заявлении, предпринято не было. Более того, с момента первой публикации в газете, вызвавшей резонанс общественности (но не полиции!), прошло уже более восьми месяцев!
Если следовать букве закона «О полиции», то его пункт 2 гласит: «Полиция незамедлительно приходит на помощь каждому, кто нуждается в ее защите от преступных и иных противоправных посягательств». В данном случае в защите от преступных посягательств нуждаются объект национального культурного достояния и бюджеты (федеральный, областной и местный), которым предстоит покрывать ущерб от действий вандалов. Статья 12 обязывает сотрудников УВД «прибывать незамедлительно на место совершения преступления … документировать обстоятельства…» Пункт 4 предписывает не только «выявлять причины преступлений…», но и «принимать в пределах своих полномочий меры по их устранению», «осуществлять оперативно-разыскную деятельность…»
Не прибыли, не пресекли, не устранили, не задокументировали, не выявили, не осуществили…
Комментарий полиции беспомощен. Как если бы вы, в условном случае, сообщаете полиции об убийце, который на ваших глазах душит ребенка, а полиция в ответ шлет запрос в институт педиатрии в таком примерно виде: «Нам заявили, что тут происходит внешнее воздействие на человека в форме механического препятствия поступлению кислорода. Разберитесь».
